I want to set something straight. Third party companies may not be 'licensed' or 'sacntioned' by HasTak, but they do fulfill a need in the fandom. That being said, they have a right to do business as they see fit. Let them worry about the 'legality' of it. If anyone has a problem with how they operate, they can take it up in a PM with the company. I will not allow any more lecturing by any member on the subject, especially if it's in a condenscending tone. If you think they shouldn't do business as a third party, that's your opinion and you're welcome to it. Don't push that opinion off on others.

Okay, forget opinions, let's examine the FACTS.

 

Statement (发表): "HERE IS VERY SPECIAL PLACE TO DISPLAY AND DISCUSS MY NEW TRANFORMER TOY------MGT-01 ARCEE."

Fact: It's NOT a Transformer toy because it's not manufactured as part of Hasbro's Transformers brand. The name "Arcee" is a trademark held by Hasbro, thus explicitly referring to this toy (in multiple occasions) as "Arcee" is legally dubious at best. It'd be different if M&G had only referred to this toy as "Delicate Warrior" or something like that.

Statement: "it is named MGT-01 ARCEE made by M&G toy co.ltd"

Observation: M&G has explicitly stated that the toy is called "Arcee"

Fact: Trademark violation.

事実： 侵犯商标权

 

Observation: The toys have Autobot insignias on their chests.

Fact: The Autobot logo is a registered trademark owned by Hasbro. Use without their permission is a TM violation.

观察: 玩具的胸有汽車人的标志

事実： 汽車人的标志是孩之宝公司的注册商标.如果你们没有宝公司的許可,用那个标志是侵犯商标权

 

Statement & Observation: "( design is based on G1 animation)"

Fact: Arcee's distinctive likeness is Hasbro's intellectual property.

事実： Arcee的鲜明的肖像是孩之宝公司的智慧产权

 

Statement: "HIGH QUALITY"

Observation: later M&G admitted that this toy is, in his words, "very delicate." This contradicts the previous statement of it being 'high quality.' A high quality toy should be a durable toy. We all criticise HasTak's MP Seekers mould for being too fragile (especially the first Takara MP Starscream) -- why shouldn't we apply the same standards/scrutiny to this toy?

Statement: "firstly, MGT-01 ARCEE is not false. because we manufacture ARCEE in accordance with G1 animation . not copy others copyright."

Fact: Arcee's distinctive likeness is Hasbro's intellectual property.

Conclusion: This is a false and misleading statement

Statement: "Although ARCEE belongs to Hasbor. in fact , Hasbor never make Arcee into a toy!"

Fact: Hasbro (and Takara) HAVE made Arcee toys. Multiple Arcee toys. While Hasbro didn't make this Arcee toy (and I have repeatedly stated that it is not a counterfeit), it is completely untrue to say that Hasbro's never made Arcee into a toy.

Conclusion: This statement is false.

Statement: "we are regretful for your behavior that you defame our company's reputation"

Fact: The definition of defamation is a false or unjustified injury of another's reputation.

Interrogative: Have I explicitly made any statements about this company which is untrue?

事実： 诽谤的意味是虚假或不合理的伤害他人的声誉。

疑問： 我已经明确提出了关于这家公司的任何陈述是不真実吗？

 

Statement: "we trust we can win a good reputation by high quality and characteristics."

Observation: But in this person's own words, this toy is "very delicate."

Interrogative: Does this not contradict the claim of "high quality"?

Statement: "we never use this kind of means to snatch the market profit."

Observation: This is questionable. It could be argued that M&G are potentially impeding on Hasbro's profits because if Hasbro were to make a "Classicsverse" Arcee toy in the future, then there may be a number of consumers who, having purchased M&G's 'Arcee' toy, choose not to purchase Hasbro's Arcee. It may not be M&G's intention, but it is a possible consequence. This is why we have laws to protect people's intellectual property which extends beyond just counterfeiting.

Fact: This company is benefitting from using Hasbro's intellectual property.

Fact: Images of certain public figures, particularly politicians, is regarded as public domain.

Conclusion: This is an irrelevant comparative analogy to use with Arcee.

Anyways, whatever laws they break is none of my concern. I like to buy toys of characters that I want. Toys with quality.... and the videos I've seen about MGT-01 says that quality is very good. I just can't/won't for the price they are asking.

 

Also, Goktimus, you gotta keep in mind that english isn't his primary language. So what he is saying might not come out the way he wants it to. When he brought up "delicate", he was talking about how they were delicate when making/putting the toy together. Like building a model. You turned that around and started talking about how the toy is delicate.

Really? I thought $50... maybe even $60 was a good price for an unassembled product with screws (no box and no stand). Thats already more than most MG 1/100 Gundam models... and those models are even bigger and also have accessories. I'm sure you'd be saving around 8 hours of man power (per figure) or however long it takes to manually cut, smooth, paint a few areas, and put the pieces together. As someone that enjoys building Gundam models, I would have no problem with it. You'd also be making money, but thats how I see it anyways. I don't run the company, I'm just looking at how the makers and customers can both benefit from an alternative option.

 

It'll always be a piece I'd be interested in. But with the lowest price online being $120.... for its size... I just can't do it.

I am not the most prolific poster to these forums, so I probably have zero clout... But even as someone who is a fan of some third party prouducts as long as they are original designs, I have to side with Goktimus on this one. This whole thread is basically an advertisement for this prouduct, which to me at best suggests it should be in one of the Marketplace forums, not in the Toy Discussion forums. And even then, while I am not a moderator of these forums, I do worry about the ethical grey area here.

 

Yes, it is a design that Hasbro or Takara have not yet made into a transforming toy. (Although they have used it in figures and statues.) But it is clearly their design. Mind you, I do have Fansproject's excellent Warbot Defender which is clearly supposed to be Springer. But it is a somewhat esthetically different Springer, not a 100% faithful reproduction of an existing design. And, while purchasers of the toy have talked about it here, there has never (to my knowledge) been a representitive of Fansproject in these forums trying to sell that toy, telling us about its virtues and defending its legality. That is happening here. And that to me seems to cross a line I am not comfortable with, making me doubt my comfort with these forums as a whole.

Yotsuyasan: +1. People talk about KOs and 3rd Party Items on this forum all the time, which really makes me feel uncomfortable, but I normally ignore such posts and threads. But what you said hit the nail on the head and is what crossed the line for me.
